How to handle advances to contract staff without disputes
Give an advance only against a written record. Note the date, the amount, the staff member's signature or thumb impression, and how it will be recovered. Then deduct it in planned instalments from wages. Under the Code on Wages, 2019, recovering an advance is an allowed deduction, but all deductions in a wage period together cannot exceed 50% of the wages. Show every recovery on the payslip so the balance is never a surprise.

Why do advances cause so many disputes?
Advances are part of daily life for contract staff: a medical bill, a family function, the fare home. The money is usually handed over in cash at the site, often by a supervisor, and written down later, if at all. By payday nobody agrees on the amount, the date, or how much was already recovered. The staff member feels cheated, the supervisor feels accused, and you lose a good worker over ₹2,000.
The fix is not to stop giving advances. It is to record them the same way every time and recover them predictably.
What does the law allow?
Since 21 November 2025, wage deductions are governed by the Code on Wages, 2019, which replaced the Payment of Wages Act, 1936. The key rules:
- Only authorised deductions. No deduction may be made from wages except those the Code allows (section 18(1)).
- Advances are allowed. Recovery of advances of any kind, and adjustment of wages paid in excess, are authorised deductions (section 18(2)(f)).
- The 50% ceiling. All deductions in a wage period together (advance recovery, fines, damage or loss, PF and ESI shares) cannot be more than 50% of the wages for that period (section 18(3)).
- Advances before joining. An advance given before employment starts is recovered from the first full wage period's pay, and an advance given for travel expenses cannot be recovered (section 23(a)).
- Other advances are recovered on the conditions the rules lay down (section 23). Your state's rules may cap the size of an advance or of each instalment, so check them.
Wages must still be paid on time: for monthly-paid staff, by the 7th of the next month (section 17). An advance is not a reason to delay the rest of the salary.
How should you record an advance?
Keep one line per advance in a register or ledger, with:
| Column | Example |
|---|---|
| Date given | 4 July 2026 |
| Staff code and name | STF-0012, Imran Shaikh |
| Amount | ₹6,000 |
| Purpose | Medical |
| Recovery plan | ₹2,000 a month for 3 months, from July wages |
| Given by | Site supervisor, Phoenix Mall |
| Signature or thumb impression | Taken at the time of payment |
Each month, write the instalment recovered and the balance left. The deduction must also appear in your wages register. Our free wages register template has columns for the deduction and its nature.
Worked example: recovering ₹6,000 inside the 50% limit
Imran earns ₹700 a day and works 24 days in July, so his wages are ₹16,800. His PF and ESI shares and the advance instalment together must stay within 50% of that, which is ₹8,400.
| Month | Wages | Advance recovered | Balance |
|---|---|---|---|
| July | ₹16,800 | ₹2,000 | ₹4,000 |
| August | ₹17,500 | ₹2,000 | ₹2,000 |
| September | ₹16,100 | ₹2,000 | ₹0 |
Taking the whole ₹6,000 in July would also be inside the 50% limit, but it would leave him with too little to live on and invite the next advance. Planned instalments keep the take-home pay steady. The staff salary calculator deducts an advance for you and shows the net payable.
What if the advance is more than the month's pay?
Do not try to recover it all at once. The 50% ceiling means at least half the wages must reach the staff member. Recover what the ceiling allows, carry the rest forward, and show the balance on the payslip. If someone leaves with an advance still outstanding, the final settlement is still subject to the same deduction rules. Take advice before withholding more.

Can you charge interest on an advance?
The Code on Wages lists the recovery of advances "and the interest due in respect thereof" among the allowed deductions, so interest is not ruled out. Most contractors do not charge it on small salary advances, and doing so tends to cost more in goodwill than it earns. If you do, write the rate into the advance record before handing over the money, and keep the interest inside the 50% deduction ceiling.
What should the payslip show?
Every month in which an advance is recovered, the payslip or wage statement should show:
- the gross wages for the period;
- the advance instalment recovered, listed separately from PF, ESI and other deductions;
- the advance balance still outstanding after this month;
- the net amount paid.
A staff member who can see the balance going down rarely disputes the deduction.
Which habits prevent disputes?
- One person approves advances, even if supervisors hand over the cash.
- Pay by bank transfer or UPI where you can, so the advance has its own record.
- Agree the recovery plan before handing over money, and write it down.
- Show the balance every month on the payslip or in a WhatsApp message.
- Close the loop. When the balance reaches zero, say so.
How does attendance tie in?
An advance is recovered from wages, and wages come from attendance. If the attendance is wrong, a staff member may be paid for days they did not work, or lose days they did, and the advance balance becomes the argument. Getting the days right is the first step to getting the recovery right. HaazriPro keeps an advances ledger per staff member and deducts it in the monthly salary sheet.
